1. Introduction

Welcome to NanoShots ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our AI image generation website and services (the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

2. User Accounts & Third-Party Services

To use our Service, you must create an account. Account creation and management are handled by our third-party authentication provider, Clerk. You are responsible for safeguarding your account and for any activities or actions under your account.

Payments for credits are processed by our third-party payment provider, Dodo Payments. We do not store or handle your credit card information.

3. User Content and AI Generation

Our Service allows you to upload your photos ("User Content") to generate new AI images ("Generated Content").

• Your Rights: You retain full ownership and all rights to your User Content. We claim no ownership over your original photos or the Generated Content.
• License to Us: By uploading User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license solely to use, reproduce, and process the User Content to provide the Service to you. This means we are only permitted to use your photo to pass it to an AI model and generate your requested image. We will not use your User Content for any other purpose, such as marketing or training AI models.
• Responsibility: You represent and warrant that you have all the necessary rights to upload your User Content and that its use by our Service will not infringe on the rights of any third party.
• AI Output: You acknowledge that Generated Content is created by artificial intelligence. While we strive for high-quality results, the output may occasionally be unexpected, inaccurate, or imperfect.

4. Credits and Payments

The Service operates on a credit system. You can purchase credit packs for a one-time fee. These credits are used to perform image generations. Due to the computational costs associated with AI generation, all credit purchases are final and non-refundable. However, if you experience a technical issue with a generation, please contact our support team, and we'll be happy to assist.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

6. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect.
